Privacy Policy

This Privacy Policy explains how Bar Yehezkel, an independent app developer based in Israel ("we", "us", "our"), the developer of the mobile game Failed Hero (the "Game"), collects, uses, and shares information when you download and play the Game on iOS or Android.

By downloading, installing, or using the Game, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Game.

1. Who We Are

The Game is developed and published by Bar Yehezkel, an independent (sole) developer based in Israel.

2. Information We Collect

We try to collect as little personal information as possible. The Game itself does not require you to create an account or provide your real name, email, or phone number.

2.1 Information you choose to provide

• Player nickname. If you choose to appear on the online leaderboard, you enter a nickname. This nickname and your best in-game distance (score) are sent to our leaderboard service and may be shown publicly to other players. Please do not use your real full name or any sensitive information as your nickname.

2.2 Information collected automatically

• Device and technical information — device model, operating system version, language, region, and general performance/crash information.
• Advertising identifiers — such as the Google Advertising ID (Android) or the Identifier for Advertisers / IDFA (iOS), used by our advertising partner to show and measure ads (see Section 3).
• Approximate, non-precise usage data — such as the number of sessions, in-game events, and gameplay statistics, used to operate and improve the Game.
• Leaderboard data — your chosen nickname and your best distance score, together with a randomly generated installation identifier used to keep your leaderboard entry consistent across sessions.

2.3 Information stored only on your device

• Game progress and settings — coins, unlocked heroes, upgrades, best distance, daily-reward streak, sound settings, language, and tutorial state are stored locally on your device (using the device's local storage / PlayerPrefs). This data is not uploaded to us, except where it forms part of the leaderboard score described above.

We do not knowingly collect your name, email address, phone number, precise GPS location, contacts, photos, or microphone/camera data.

3. Advertising

The Game is supported by advertising provided through Google AdMob (a Google service). AdMob may show banner, interstitial (full-screen), and rewarded video ads.

To serve and measure ads, AdMob and its partners may collect and process device identifiers (such as the advertising ID), IP address, and ad-interaction data. Ads may be personalized or non-personalized depending on your consent and device settings.

• You can reset or limit your advertising ID at any time in your device settings:
  • Android: Settings → Google → Ads
  • iOS: Settings → Privacy & Security → Tracking / Apple Advertising

If you purchase "Remove Ads" inside the Game, banner and interstitial ads are disabled. (Rewarded ads remain available only if you actively choose to watch one for a bonus.)

4. In-App Purchases

The Game offers optional in-app purchases (for example, "Remove Ads" and coin packs). Purchases are processed by the Apple App Store or Google Play Store. We do not receive or store your full payment-card details — these are handled directly by Apple or Google under their own privacy policies.

5. Third-Party Services

These third parties may process your information on servers located outside your country of residence.

6. How We Use Information

• Operate, maintain, and provide the Game and its features;
• Display and synchronize the online leaderboard;
• Show and measure advertising;
• Process in-app purchases;
• Diagnose crashes, fix bugs, and improve performance and gameplay;
• Protect against fraud, abuse, and technical problems.

We do not sell your personal information.

7. Legal Bases (for users in the EEA / UK)

Where the EU/UK General Data Protection Regulation (GDPR) applies, we rely on the following legal bases:

• Consent — for personalized advertising and any non-essential data processing;
• Legitimate interests — for operating the Game, securing it, and improving it;
• Performance of a contract — for providing features you request, such as leaderboard participation and in-app purchases.

You may withdraw your consent at any time (for example, by adjusting your device's ad/tracking settings).

8. Children's Privacy

Failed Hero is a general-audience game. It is not directed primarily at children, but it has a cartoon style and we recognize that some of our players may be children. We are committed to protecting their privacy.

• We do not knowingly collect personal information (such as real name, email, or phone number) from children under the age of 13 (or the minimum age in your country).
• Because our audience is mixed, we use an age-neutral approach and, where required by the app stores, present a neutral age screen and configure our advertising partner (Google AdMob) to serve age-appropriate ads.
• If you are a parent or guardian and believe your child has provided us with personal information, please contact us at bar@kinetiq.co.il and we will delete it.

9. Data Retention

• Data stored locally on your device remains until you delete the Game or clear its data.
• Leaderboard data (nickname and score) is retained for as long as the leaderboard is operated, or until you ask us to remove it.
• Advertising data is retained according to the policies of our advertising partners.

10. Your Rights

Depending on where you live, you may have the right to access, correct, or delete your information; object to or restrict certain processing; withdraw consent for advertising/tracking; and request that your leaderboard entry be removed. To exercise any of these rights, contact us at bar@kinetiq.co.il. We will respond within the time required by applicable law.

California residents (CCPA/CPRA): We do not sell or share your personal information for cross-context behavioral advertising beyond what is described above, and you have the right to know, delete, and opt out as provided by law.

11. Security

We take reasonable technical and organizational measures to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12. International Transfers

We are based in Israel. Your information may be processed and stored on servers located in countries other than your own — including by the third-party services listed above. Where required, appropriate safeguards are applied.

13. Governing Law

This Privacy Policy and any matter relating to it are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules, in addition to any mandatory data-protection rights you have under the laws of your own country of residence.

14. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and update the version published at kinetiq.co.il/failed_hero/privacy_policy.html. Significant changes may be announced within the Game or on the store listing. Your continued use of the Game after changes take effect means you accept the updated policy.
